Who Really Owns Styro-Solve(TM)?

On July 9, 2009 Hard To Treat Diseases (PINK:HTDS) announced that it would be reasserting its ownership rights to certain intellectual property which was inappropriately converted by the previous management of HTDS (Source: PRNewsWire.com). The company was careful at that time not to divulge the particulars of the intellectual property or the OTCBB company that they were reasserting their rights against, but they did give a link in their article to a filing located at PinkSheets.com. In the filing, Hard To Treat Diseases - then known as International Foam Solutions, Inc. - states as follows:

"International Foam Solutions, Inc., ("IFS, Inc.") was incorporated under the laws of the State of Florida in May 1993. IFS, Inc. produces and markets a self-contained system, termed the "Styro Solve System," which utilizes IFS, Inc.'s "Solution Machine" and a "Styro Solve" solution, for disposing of and recycling polystyrene foam products."

I was curious and poked around for information on which company it was that Hard To Treat Diseases might be reasserting their intellectual property rights against. In doing so, I came across an article at Financial Content dated July 30, 2008 titled 'Blue Earth Solutions Announces Two New Foam Recycling Contracts'. In the article, under the sub-heading 'About Blue Earth Solutions, Inc.', it is stated as follows:

"Our Styro-Solve(TM) process can reduce the planets consumption of oil, a major part of polystyrene manufacturing, which further increases the value of our process."

Note that no accusations are being made herein, just that an article was discovered online in which Blue Earth Solutions, Inc. is described as being the owner of "Styro-Solve(TM)" and Hard To Treat Diseases had laid claim to ownership several years prior to the publication of that article.

Blue Earth Solutions, Inc. (OTC:BESN) is a fully reporting OTCBB company, just as is described in the article 'Hard To Treat Diseases (HTDS.PK) Completes IP Ownership Filings With U.S. Patent and Trademark Office' released earlier today. The following is an excerpt from that article:

"In summary, The IP rights are being utilized by a fully reporting OTCBB publicly traded company. As a result of HTDS IP rights, this company has raised substantial monies in equity financing, constructed an operating plant that generates revenue, is in the process of purchasing parcels of property in various States in order to construct additional plants. It also has had numerous industrial bonds approved for several million dollars each."

So, two questions dance around in my head: Firstly, is Blue Earth Solutions, Inc. the company that Hard To Treat Diseases is making a claim of intellectual property rights against? Secondly, who really owns the rights to Styro-Solve(TM)?
